FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE: It is recommended that Plaintiffs' amended complaint be summarily DISMISSED WITH PREJUDICE for failure to state a claim upon which relief can be granted, see 28 U.S.C. § 1915(e)(2)(B), unless Plaintiffs amend their complaint, within 14 days of the date of this recommendation, to allege a viable claim against one or more Defendants under 42 U.S.C. § 3604(f)(2) and 3617. ORDER: The United States Magistrate Judge made Findings, Conclusions, and a Recommendation in this case, among other things recommending dismissal if Plaintiffs did not amend. They have now done so. RECOMMENDATION REGARDING NON-PRISONER'S IFP STATUS ON APPEAL: It is recommended that the Court deny Sherrie R. Lowe's motion to proceed in forma pauperis on appeal 67, and certify, pursuant to FED. R. APP. P. 24(a) and 28 U.S.C. § 1915(a)(3), that the appeal is not taken in good faith in light of this Court's 1/11/2016 order 64 accepting the findings, conclusions and recommendation of the Magistrate Judge 62. See Howard v. King, 707 F.2d 215, 220 (5th Cir. 1983) (an appeal is not taken in good faith when it fails to present non-frivolous issues).
