Memorandum Opinion and Order: The court concludes that Tinker Inc. is not entitled to recover on its claim of trademark infringement in violation of the Lanham Act; unfair competition in violation of the Lanham Act and; unfair competition under Texas law against Defendants. The court concludes that Defendants are not entitled to recover on their counterclaims of unfair competition in violation of the Lanham Act; unfair competition under Texas law trademark registration obtained by fraud; tortious interference with business relations; and business disparagement against Tinker Inc.
