Findings, Conclusions, and Recommendation re: 30 Defendant's Motion to Dismiss Plaintiff's 3rd Amended Complaint for Failure to State a Claim. Defendant's Rule 12(b)(6) motion should be GRANTED, and Plaintiff's federal claims should be DISMISSED with prejudice for failure to state a claim. The Court should decline to exercise supplemental jurisdiction over Plaintiff's state law claims and they should be DISMISSED without prejudice to her pursuing them in state court.
