ORDER ADOPTING 43 REPORT AND RECOMMENDATION. For the reasons stated herein, Magistrate Judge Bloom's Report and Recommendation dated December 22, 2014, is adopted in its entirety. Defendants' motion to transfer this action to the Northern District of Texas is granted. It is further ordered that Defendants' motion to dismiss for lack of personal jurisdiction is denied as moot, and Plaintiff's request for jurisdictional discovery is denied. AT&T Inc. and AT&T Services, Inc.'s motion to dismiss for failure to state a claim is denied without prejudice. Defendants may renew their motion in the transferee court. Ordered by Judge Sandra L. MEMORANDUM OPINION AND ORDER: The Court GRANTS the AT&T ILECs' 219 Motion for Summary Judgment as to Count 2 (breach of contract), Count 4 (attorneys' fees and litigation expenses), and Count 6 (application for permanent injunction). Because of the Court granting summary judgment on Count 2, the AT&T ILECs' motion as to Count 5 (declaratory judgment) is dismissed because it is duplicative.
