Findings, Conclusions, and Recommendation re: 8 Motion to Dismiss Plaintiff's Original Complaint and Brief in Support. If Plaintiff does not file an amended complaint that states a claim for relief within the 14 days allowed for objections to this recommendation, or a deadline otherwise set by the Court, Defendant's motion to dismiss should be GRANTED, and Plaintiff's claims should be dismissed with prejudice. If Plaintiff timely files an amended complaint, however, Defendant's motion to dismiss should be DENIED as moot, and the action should be allowed to proceed on the amended complaint. ORDER ACCEPTING 18 FINDINGS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE: Since Plaintiffs have timely filed an amended complaint as allowed by the recommendation, the Motion to Dismiss Plaintiff's Original Complaint and Brief in Support, filed 6/30/2015 (doc. 8), is DENIED as moot. This action will now proceed on the amended complaint. Defendants may, however, reassert their Motion to Dismiss to assert that the amended complaint does not state a plausible claim for relief.
