FINDINGS, CONCLUSIONS, AND RECOMMENDATION: It is recommended that the Individually Named City Defendants' Partial Summary Judgment Motion 24 be GRANTED. Plaintiff's claims under § 1983 and § 1985(2) against Individual Defendants should be DISMISSED with prejudice on grounds of qualified immunity. All state law claims against them remain pending. Findings, Conclusions, and Recommendation re: 41 Defendants' 12(b)(6) Motion to Dismiss. If Plaintiff does not file an amended complaint within the 14 days allotted for objections to this recommendation, or a deadline otherwise set by the Court, Defendants' motion to dismiss should be GRANTED, and all of Plaintiff's claims should be DISMISSED with prejudice for failure to state a claim. If Plaintiff timely files an amended complaint, however, the motion to dismiss should be DENIED as moot, and the action should be allowed to proceed on the amended complaint.
