No. 78] should be GRANTED in part and DENIED in part. All claims asserted by Plaintiff Jerry Chambers should be dismissed with prejudice. Plaintiff Marsha Chambers's claims for violations of the Texas Deceptive Trade Practices Act, Texas Debt Collection Practices Act, intentional infliction of emotional distress, unjust enrichment, and common law fraud should be dismissed with prejudice, and her claims for violations of Texas Business and Commerce Code § 27.01 and Texas Business and Commerce Code § 305.053 should not be dismissed.
