FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE: Defendant Bank of New York Mellon's 14 Motion for Summary Judgment should be granted in part and denied in part, as follows: The Motion for Summary Judgment as to Plaintiff Debra Pruitt's breach of contract claim should be denied. On all other claims specifically, Plaintiff Steve Pruitt's breach of contract claim and both Plaintiffs' claims for common law fraud and breach of duty to deal in good faith the Bank's 14 Motion for Summary Judgment should be granted, and the claims dismissed with prejudice.
