FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE. Before the Court is Defendants Incipio Technologies, Inc. and Braven, L.C.'s Motion to Compel Arbitration and Stay Lawsuit Pending Arbitration [D.E. 6]. The undersigned recommends that Defendants' Motion to Compel Arbitration and Stay Lawsuit Pending Arbitration [D.E. 6] be GRANTED and that the Court issue an order staying proceedings and requiring the parties to participate in arbitration according to the terms included in the contract. Order Accepting Findings and Recommendations re: 20 Findings and Recommendations on Motion re: 6 Motion to Compel filed by Braven LC, Incipio Technologies Inc. The court, however, rejects the Reports recommendation that the action be stayed pending the completion of arbitration. The court grants the Motion to Compel Arbitration, denies the Motion to Stay Lawsuit Pending Arbitration, orders the parties to arbitrate this action in accordance with the terms and provisions of the Agreement, and dismisses this action with prejudice.
