FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE re: 27 Motion for Summary Judgment. The Court finds that MERS has met its burden of demonstrating that it is entitled to judgment as a matter of law because based on the undisputed facts, there is no genuine issue of material fact for trial. Accordingly, the Court respectfully recommends that the district court GRANT Defendant's 27 Motion for Summary Judgment. FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE re: 25 Dismiss for Failure to State a Claim, 35 Dismiss for Failure to State a Claim. The Court respectfully recommends that the District Court GRANT Carrington's 35 Motion to Dismiss in its entirety. The Court also respectfully recommends the district court should GRANT in part and DENY in part WTNA and Shellpoint's 25 Motion to Dismiss. Plaintiffs' claims for wrongful foreclosure should be dismissed with prejudice. Plaintiffs' claims for breach of contract against WTNA should be dismissed with prejudice. The district court should deny Defendants' 25 motion as to Plaintiffs' breach of contract claim against Shellpoint.
