MEMORANDUM OPINION AND ORDER: the court overrules Allstate's objection regarding the amount in controversy. The court lacks subject matter jurisdiction to entertain this action and remands it to the 95th Judicial District Court of Dallas County, Texas, from where it was removed. The court directs the clerk of court to effect the remand in accordance with the usual procedure. The court sustains Allstate's objection to that part of the Report that recommends it pay Perez's reasonable attorney's fees. Perez is not entitled to recover his attorney's fees and costs, and no attorney's fees and costs are awarded. (Ordered by Judge Sam A Lindsay on 4/28/2017) (sss)
