Findings, Conclusions, and Recommendation re: 13 Defendants' Motion to Dismiss Plaintiff's First Amended Complaint. Defendants' Rule 12(b)(1) motion to dismiss should be DENIED, and their Rule 12(b)(6) motion to dismiss should be GRANTED in part. Plaintiff's Bivens claims should be DISMISSED with prejudice for failure to state a claim, and his APA claims should sua sponte be DISMISSED without prejudice for lack of subject-matter jurisdiction.
