Order Accepting 13 Findings and Recommendations. The court grants Defendant's 7 Motion to Dismiss; and dismisses with prejudice Plaintiff's RICO cause of action under Rule 12(b)(6) for failure to state a claim upon which relief can be granted. Further, for the reasons stated by the magistrate judge, the court will not allow Plaintiff to amend his pleadings. As no other claims remain, the court will enter judgment by separate order.
