FINDINGS, CONCLUSIONS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE: Defendants' Motion 24 to Dismiss should be GRANTED and Plaintiff's claims should be DISMISSED WITH PREJUDICE. Defendant American Airlines' separate Motion 27 to Dismiss should be DENIED AS MOOT. Finally, Plaintiff should be warned that if he persists in filing frivolous, baseless or duplicative actions, or actions over which the Court lacks subject matter jurisdiction, the Court may impose monetary sanctions and/or bar him from bringing any future actions.
