ORDER GRANTING RELIEF ON REMAINING CLAIM UNDER 28 U.S.C. SECTION 2255, VACATING SENTENCE and, SETTING HEARING ON RE-SENTENCING....Memorandum Opinion and Order as to John Turner granting 2192 Motion to Vacate (2255). Therefore, John Turner's remaining claim for relief under 28 U.S.C. section 2255 is GRANTED, to the extent that the sentence of imprisonment imposed in the December 12, 2001, Judgment in a Criminal Case is VACATED, pending this Court's resentencing of Turner. Turner shall remain in the custody of the United States on the same terms as prior to trial until further order of the Court. A hearing on the resentencing of defendant John Turner is set for Monday June 11, 2007, at 10:30am. The government shall prepare the paperwork and writs necessary to have defendant John Turner in attendance at the June 11, 2007, hearing.
