ORDER partially granting in part and partially denying in part 37 Motion for Summary Judgment...the Court concludes that there is a genuine issue of material fact as to whether American discriminated against Parker because it regarded him as disabled. American is not liable for failing to provide Parker with reasonable accomodation because Parker failed to request any reasonable accomodation from American. Parker has waived or abandoned his claim of disability discrimination based on a record of disability. And Parker has failed to make out a prima facie case under the Texas Worker's Compensation Act.
