MEMORANDUM OPINION and ORDER: The court concludes that the Motion to Dismiss 6 should be granted in part and denied in part. The court ORDERS that the motion to dismiss filed by defendant be, and is hereby, granted in part, and that all claims and causes of action asserted by plaintiff against defendant except plaintiff's claims for promissory estoppel and breach of contract as to the loan modification agreement be, and are hereby, dismissed with prejudice.
