Memorandum Opinion and Order: Having considered the motions 35, 37, 39, the response of plaintiff, JMO Property, LLC, defendants' replies, the record, and applicable authorities, the court has concluded that the motions for leave should be granted and that MJC, FS1, LeVecke, Langfield, and Swan, should be designated in this action as responsible third parties as contemplated by section 33.004 of the Texas Civil Practice and Remedies Code...The court ORDERS that defendants' motions to designate MJC, FS1, LeVecke, and Langfield, and CERE's motion to also designate Swan, be, and are hereby, granted, and the court deems that such a designation has occurred.
