ORDER ACCEPTING FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE: The United States Magistrate Judge issued a Report and Recommendation ("R&R") (ECF No. 19) in this case. The R&R recommended that this Court deny Allstate's motion to dismiss. Allstate has filed objections. The Court has conducted a de novo review of those portions of the R&R to which an objection was made. For the following reasons, Allstate's objections are overruled, and the R&R is accepted as the Findings and Conclusions of the Court. Accordingly, it is ORDERED that Defendant Allstate Vehicle and Property Insurance Company's Rule 12(b)(1) Partial Motion to Dismiss for Lack of Subject Matter Jurisdiction and Rule 12(b)(6) Partial Motion to Dismiss (ECF No. 7) is DENIED.
