ORDER ADOPTING 43 Findings and Recommendations: Accordingly, it is ORDERED that the portions of Magistrate Judges Findings and Recommendation to which Plaintiff did not object should be and hereby are ADOPTED. It is further ORDERED that Plaintiffs objections to the Magistrate Judges Recommendation are DENIED. For the forgoing reasons, the Court finds that the Findings, Conclusions and Recommendation of the Magistrate Judge dated October 14, 2008 are correct, and they are adopted as the findings and conclusions of the Court.
