ORDER granting in part and denying in part 75 Gulf Restoration Network and The Ocean Conservancy's Motion for Summary Judgment; granting in part and denying in part 76 Coastal Conservation Association's Motion for Summary Judgment; granting in part and denying in part 78 US Dept of Commerce, Carlos Gutierrez, National Marine Fisheries Service, National Oceanic and Atmospheric Administration's Cross Motion for Summary Judgment. Specifically, Plaintiffs' motions for SJ on their claim that the Service violated APA and the Fishery Act when it promulgated Amendment 22 are GRANTED. Defendants' motion for summary judgment on 1) Plaintiffs' claim that the Service violated NEPA and 2) CCA's claim that the Secretary violated the APA and the Fishery when he denied CCA's petition for emergency rule making is also GRANTED. The status quo must be maintained during the pedency of the remand.
