OPINION & ORDER The 25 Motions to Dismiss for lack of Personal Jurisdiction filed by the following Defendants, individually, are DENIED; Defendant Treasury Capital; Defendant Ronald M. Organ; Defendant T. Garth Collier; and Defendant Irving Birnbaum. Defendant Phoenix Partners' 30 MOTION to Dismiss Presenting Defenses of Lack of Personal Jurisdiction, Improper Venue, Failure to State A Claim, Failure to Plead with Particularity and in the Alternative, Motion for a More Definite Statement is DENIED in part and GRANTED in part. To the extent Defendant Phoenix Partners moves for dismissal for lack of personal jurisdiction, improper venue, and for failure to plead fraud with particularity, the Motion is DENIED as moot, as is its Motion for a More Definite Statement. To the extent Phoenix Partners moves for dismissal of Plaintiff's breach of contract claim for failure to state a claim, the Motion is GRANTED. Defendants Treasury Oil, Treasury Capital, Treasury Leasing, Irving Brinbaum, Ronald Organ, and T. Garth Colliers' Motion to Dismiss for failure to State a Claim is GRANTED with respect to Plaintiff's breach of contract claim, but DENIED with respect to Plaintiff's remaining claims.( Signed by Judge Micaela Alvarez ) Parties notified.(gsalinas, )
