MEMORANDUM DECISION and ORDER for Service of Process (Prisoner). The United States Marshals Service shall serve a summons, a copy of Plaintiffs complaint, and a copy of this Order upon Defendants Scott Crowther, FNU Tubbs. Within 20 days of being served, Defendants must file an answer or motion to dismiss, as outlined in this order. If filing a Martinez report, Defendants must do so within 90 days of filing their answers. Under this option, Defendants must then file a summary-judgment motion within 120 days of filing their answers. If served with a Martinez report, Plaintiff may submit a response within 30 days of the reports filing date. If served with a summary-judgment motion or motion to dismiss, Plaintiff must submit a response within 30 days of the motions filing date. Summary-judgment motion deadline is 120 days from filing of answer. MEMORANDUM DECISION and ORDER: IT IS HEREBY ORDERED that: If the State is unable to accept service of process for the defendants identified above, the State shall disclose to the United States Marshals Service any information in its records that may help in identifying, locating and not limited to, the defendants full names and any known aliases, dates of birth, Social Security numbers, driver's license numbers, all previous addresses, and last known addresses on file. The U.S. Marshal shall take all necessary measures to safeguard any personal information provided by the State to ensure that it is not disclosed to anyone other than the U.S. Marshals Service or Court officers.IT IS SO ORDERED Signed by Judge Jill N.
