MEMORANDUM DECISION AND ORDER granting 23 Motion to Dismiss; The trade dress infringement claim is DISMISSED WITHOUT PREJUDICE for failure to state a claim upon which relief can be granted. The patent infringement claim is DISMISSED WITH PREJUDICE because claim 1 of the asserted 740 patent is invalid. The court has dismissed both of Domos federal claims. Accordingly, the remaining state-law claims of fraud, tortious interference, unfair competition, and deceptive trade practices are DISMISSED WITHOUT PREJUDICE FOR LACK OF SUBJECT-MATTER JURISDICTION.
