ORDER GRANTING IN PART AND DENYING IN PART DEFENDANTS MOTION TO DISMISS. Defendants Motion to Dismiss ECF No. 3 is GRANTED in part and DENIED in part. Defendants Motion is GRANTED as to the Fourth, Fifth, and Sixth Causes of Action in Plaintiffs First Amended Complaint. Defendants Motion as to all other claims is DENIED.
