REPORT AND RECOMMENDATION. It is recommended that the 13 Bivens Complaint be dismissed, with prejudice, the 12 FTCA Complaint be dismissed with prejudice and the Plaintiff's 34 Motion to Add Defendants be denied, without prejudice. To the extend that Plaintiff's pending 34 Motion seeks to call expert witnesses or engage in discovery, the same should be denied, as moot. Within fourteen (14) days after being served with a copy of this Report and Recommendation, any party may file with the Clerk of the Court written objections identifying the portions of the Report and Recommendation to which objection is made, and the basis for such objection.
