REPORT AND RECOMMENDATION; Magistrate Judge recommends that the defendants Motions to Dismiss [ECF No. 24] be GRANTED and plaintiffs complaint [ECF No. 1] be DENIED and DISMISSED with prejudice as to Defendants OBrien, Nolte, Mims, and Fitzhugh for failure to state a claim upon which relief can be granted, and DISMISSED with prejudice against Defendants Bushman and Rebault because the claims against them cannot survive on the merits even had they been served; plaintiffs pending Motion to Amend [ECF No. 33] be GRANTED and his pending Motion for Appointed Counsel [ECF No. 33] be DENIED as moot.
