REPORT AND RECOMMENDATION as to Roland F. Chalifoux, Jr.: the Court RECOMMENDS that 31 Defendant's Motion to Dismiss the Indictment or, in the Alternative, to Suppress Evidence Obtained from the Yahoo Search Warrant is hereby DENIED AS MOOT WITHOUT PREJUDICE. The Court ordered Counsel for Defendant to file a new motion on or before Wednesday, April 4, 2018. The Court further instructed the Government reply to any such motion on or before Monday, April 16, 2018. If a motion is filed, the Court will hold a hearing to address it at 1:30 p.m. on Tuesday, April 17, 2018. Written objections may be filed within fourteen days after being served with a copy of this Report and Recommendation.
